This case is dismissed solely as it relates to this Defendant with leave to reinstate within one hundred and eighty (180) days, at such time, absent a motion to reinstate, shall automatically convert to a dismissal with prejudice. 6. PRELIMINARY INJUNCTION ORDER: THIS COURT having determined that the evidence submitted in support of the Application establishes the following: 1. Through the Declarations of Joseph Jurbala and Martin Yi and accompanying evidence, Plaintiff is likely to prevail on its claims of trademark infringement and counterfeiting and copyright infringement as follows, as further set forth. 2. Defendants' continued and unauthorized use of the BLUSHCRUNCH Intellectual property is likely to irreparable harm Plaintiff through diminished goodwill and brand confidence, damage to Plaintiffs reputation, loss of exclusivity, and loss of future sales; 3. On balance, the potential harm to Defendants of being prevented from continuing to profit from infringing activities if a preliminary injunction is ordered is outweighed by the potential harm to Plaintiff if a preliminary injunction is not ordered; as further set forth. NOW THEREFORE, on this 16th day of September, 2026, this Court ORDERS that 1. Defendants, their officers, agents, servants, employees, attorneys, and all persons acting for, with, by, through, under, or in active conce1i with them be temporarily enjoined and restrained from: a. Using the BLUSHCRUNCH Intellectual Property or any reproductions, counterfeit copies, or colorable imitations thereof in any manner in connection with the distribution, marketing, advertising, offering for sale, or sale of any Counterfeit Products; as further set forth. Service via electronic means does not violate the Hague Service Convention as Defendants' addresses are unknown or unverifiable despite Plaintiff's due diligence. See Smarty Study Co., Ltd. v. Shennzhenshixindajixieyouxiangongsi, 164 F. 4th 164, 168 (2d Cir. 2025). 7. Any Defendants that are subject to this Order may appear and move to dissolve or modify the Order on two days' notice to Plaintiff or on shorter notice as set by this Court. 8. The five thousand dollar ($5,000.00) bond posted by Plaintiff shall remain with the Court until a final disposition of this case or until this Preliminary Injunction is terminated.
