ORDER GRANTING LIMITED EXPEDITED DISCOVERY Signed by the Honorable LaShonda A. Hunt on 10/27/2026. Mailed notice (gel,)

#20

MINUTE entry before the Honorable LaShonda A. Hunt: Plaintiff's motion for leave to conduct expedited discovery [17] is granted in part as modified and denied in part. The Court grants Plaintiff's request for expedited discovery as the Court finds that expedited discovery is warranted to obtain Defendant's contact information. But discovery into Defendant's financials is, again, denied. As the Court already noted in its previous order, "Plaintiff seeks expedited discovery into Defendant's bank accounts and payment systems but has not yet even served the Defendant." (Dkt. 16 at pg. 2). Nothing has changed on that front. Enter Order Authorizing Expedited Discovery. Plaintiff's request to authorize notice of any preliminary injunction motion by email to Defendant is denied without prejudice. The motion hearing set for 10/29/26 [19] is stricken. If no other relief has been sought, Plaintiff is ordered to file a status report by 11/16/26 updating the Court on the progress of expedited discovery and proposed next steps in the case. Mailed notice (gel,)

ORDER Signed by the Honorable LaShonda A. Hunt on 10/9/2026. Mailed notice (gel,)

#15

MINUTE entry before the Honorable LaShonda A. Hunt: This case has been reassigned to Judge LaShonda A. Hunt pursuant to Local Rule 40.3(b)(2). Judge Tharp ordered this case reassigned because Case No. 26-cv-08364, involving the same Plaintiff, Defendant, and set of operative facts, was previously before this Court. All attorneys and self-represented ("pro se") parties are required to review the case procedures posted on the Court's webpage, including the requirement to set motions for in-person presentment on at least three business days' notice and propose an agreed briefing schedule for opposed motions. Filings that do not comply with the Local Rules or Judge Hunt's case procedures may be summarily stricken. For the reasons described in the accompanying written order, the previous order [6] on Plaintiff's motion to leave to file under seal [5] is vacated and Plaintiff's motions to file under seal [5] [11] are denied. The Clerk of Court is directed to unseal the documents filed at [2] [10]. The Clerk's office is also directed to update the caption to reflect that the Defendant in this case is "USTCOT". Second, Plaintiff's motion for leave to file excess pages [12] is granted, but its ex parte motion for a TRO and other relief [8] is denied without prejudice. By 10/21/26, Plaintiff is ordered to file a status report proposing next steps in this case, if no other appropriate relief has been sought by that date. Considering the history of this case, failure to comply with this order will result in the case being dismissed with prejudice for want of prosecution and non-compliance with court orders. Mailed notice (gel,)

#14

MINUTE entry before the Executive Committee: Case reassigned to the Honorable LaShonda A. Hunt for all further proceedings pursuant to Local Rule 40.3(b)(2). Mailed notice.

#13

MINUTE entry before the Honorable John J. Tharp, Jr: The Civil Cover Sheet in this case [3] erroneously states that this case is not a refiling of a previously dismissed action. Although the Civil Cover Sheet reflects a "related" case before Judge Hunt, 26-cv-8364, Plaintiff's status report [7] further states that "the single Defendant in this case was named previously in that case," an infringement action over the same copyright. There is no distinction between the two cases except that there is only one defendant here. Judge Hunt dismissed case no. 26-cv-8364 on 8/19/2026, and the Plaintiff filed the instant case on 9/21/2026. This case should be reassigned to the calendar of Judge Hunt pursuant to Local Rule 40.3(b)(2) ("When a case is dismissed with prejudice or without, and a second case is filed involving the same parties and relating to the same subject matter, the second case shall be assigned to the judge to whom the first case was assigned. The designation sheet presented at the time the second case is filed shall indicate the number of the earlier case and the name of the judge to whom it was assigned." See Local Rule 40.3.) The Court requests that the Executive Committee approve the reassignment. The Clerk is directed to forward a copy of this order to the Executive Committee and to Judge Hunt. Mailed notice

#6

MINUTE entry before the Honorable John J. Tharp, Jr: The plaintiff's motion for leave to file temporarily under seal [5] is granted. The sealed exhibit [2] may remain under seal until the defendants are served, at which time the exhibit will be unsealed. By 9/29/206 the plaintiff is required to file (1) a listing of all prior online trademark, copyright, or patent infringement cases (also known as "Schedule A" cases) filed in any court in the United States in which it was a plaintiff, and (2) a listing of any of the defendants included in the Schedule A in this case that the plaintiff has previously named as a defendant in any prior complaint or Schedule A case. Amy forthcoming motion for TRO or expedited discovery must be accompanied by evidence that sales actually took place in Illinois. See Liu v. Monthly, 170 F.4th 1090, 1093 (7th Cir. 2026). The plaintiff must show that the product was actually sold to Illinois residents, such as proof of payment. Records consisting of screenshots of the website of an e-commerce platform, such as Amazon, showing the checkout page with the infringing product, an Illinois shipping address, and the estimated total, are insufficient to show a completed purchase in Illinois. That evidence of purposefully directed activities is the bare minimum for establishing personal jurisdiction in schedule A cases. See NBA Properties, Inc. v. HANWJH, 46 F.4th 614 (7th Cir. 2022). Additionally, if the plaintiff intends to file a motion for alternative service, the plaintiff is advised that such a motion must be accompanied by supplemental briefing as to whether the Hague Convention applies to this case. See Kangol LLC v. Hangzhou Chuanyue Silk Imp. & Exp. Co., 177 F.4th 793, 799 (7th Cir. 2026). If the plaintiff determines that it does not apply, such a motion must include a specific explanation of the methods used to reach that conclusion. The Court also advises that motions to seal motions for expedited discovery and/or alternative service will not be granted in the absence of a TRO. Mailed notice
