MINUTE entry before the Honorable Lindsay C. Jenkins: The motion to seal [4] is denied. Plaintiff's complaint is against one defendant, and this court is not persuaded that general fears, unsupported by any evidence or declaration specific to the single defendant, that online storefronts will close and money moved provide good cause to conceal defendant's identity in the public court file. Documents necessary to identify defendant and determine the proper method of service of process are not likely to be permanently lost. Moving money does not defeat an accounting of past sales and the court doubts that plaintiff intends to pursue an accounting. As previously noted, the court is not likely to order an ex parte prejudgment asset restraint. Prejudgment restraints are not to be used to aid collection of damages. The court assumes plaintiff conducted a pre-suit investigation to support its allegations and this case should be handled like any other lawsuit: with public and adversarial litigation. The clerk shall immediately unseal [4] and correct the caption to reflect that the defendant is "xiezhaogui." The October 27, 2026, initial status hearing is stricken. Plaintiff must take some action to advance the case by November 5, 2026. Mailed notice.

10 条记录MINUTE entry before the Honorable Lindsay C. Jenkins: An in person initial status hearing set for October 27, 2026 at 9:00 a.m. in Courtroom 2119. Initial Status Report shall be filed by October 20, 2026. The report should comply with the requirements set forth in the Initial Status Report standing order, which can be found at Judge Jenkins's web page @ (http://www.ilnd.uscourts.gov, "District Judges", to "Judge Lindsay Jenkins", to "Initial Status Hearings" under Case Management Procedures"). The parties must follow all the standing orders for Judge Jenkins and all Local Rules, which can be found at the same web page. Upon review of the complaint, the court advises Plaintiff that no motion for an ex parte temporary restraining order should be filed in this matter without Plaintiff first consulting this Court's order in Wham-O Holding v. The Partnerships, 24 CV 12523, Dkt. 39 (N.D. Ill. Feb. 20, 2025). Mailed notice.
