NOTICE of Voluntary Dismissal by New Amazei Corp

原告撤诉/结案
#10

MINUTE entry before the Honorable Jorge L. Alonso: The Court has reviewed Plaintiff's status report [9]. Plaintiff has not identified the defendants, does not know their identities, does not describe any efforts it has made toward identifying them via expedited discovery, and does not propose any date by which it will move for expedited discovery, much less serve the defendants, although this case was filed approximately four months ago. Federal Rule of Civil Procedure 4(m) provides that, if a defendant is not served within 90 days after the complaint is filed, the Court must -- after notice to the plaintiff -- dismiss the action without prejudice or order that service be made within a specified time. By 10/1/26, Plaintiff must file a memorandum to show cause why this case should not be dismissed without prejudice for lack of service. If Plaintiff does not file anything, this case will be dismissed without prejudice for lack of service. The 9/17/26 status hearing is stricken. Notice mailed by Judge's staff

MINUTE entry before the Honorable Jorge L. Alonso: Plaintiff's motion for temporary restraining order [6] is denied because Plaintiff has not identified any defendants, even in the provisionally sealed materials. If Plaintiff requires expedited discovery to identify the defendants, then it should seek expedited discovery first, and then seek a temporary restraining order or preliminary injunction, if appropriate. Additionally, the Court's published Case Procedures, https://www.ilnd.uscourts.gov/judge_display.php?LastName=Alonso, for counterfeit-product and "Schedule A" cases, provide that the Court will not grant a motion for a temporary restraining order unless the Plaintiff submits evidence to demonstrate that each defendant has sold an infringing product to a customer in Illinois. Although this case is not exactly a Schedule A case, it is similar enough that the Court will apply a similar requirement here. Any renewed motion for a temporary restraining order must be accompanied by evidence that each defendant sold a product that competes with Plaintiff's "Bug Zapper Light" products to a customer in Illinois, or that there is some other substantial basis for personal jurisdiction over Defendants in Illinois. Evidence of Plaintiff's sales to Illinois will not assist Plaintiff in fulfilling this requirement. The motion to seal [5] is granted. The status hearing set for 7/22/26 is stricken and re-set for 8/5/26. Mailed notice.
