MEMORANDUM by Kelly Toys Holdings, LLC in support of motion for miscellaneous relief[81]
MOTION by Plaintiff Kelly Toys Holdings, LLC for Electronic Service of Process Pursuant to Fed. R. Civ. P. 4(f)(3) (Renewed)
MINUTE entry before the Honorable Charles P. Kocoras: Plaintiff's motion for entry of default and default judgment [70] is denied without prejudice to renewal. Entry of default requires proper service of process, and the Hague Service Convention prohibits service by email in China. Such service is proper only if the Convention does not apply because the defendant's address is "not known" after the plaintiff has made reasonably diligent efforts to ascertain and verify it. Kangol LLC v. Hangzhou Chuanyue Silk Imp. & Exp. Co., 177 F.4th 793, 799 (7th Cir. 2026) (citing NBA Props., Inc. v. P'ships & Unincorporated Ass'ns Identified in Schedule "A", 549 F. Supp. 3d 790, 796 (N.D. Ill. 2021)). Plaintiff's memorandum in support of its motion for default judgment [71] makes only passing reference to Kangol and does not engage with the declaration on which its diligence showing apparently rests. That declaration [73] states that Plaintiff searched for Defendants' addresses using Google and Baidu, and, without explanation, concludes that the searches "either did not locate this address or did not include any results for this specific address showing that it is affiliated with" the Defendants. Plaintiff's supplement [78] and supporting declaration [79] add that Plaintiff also searched Qichacha, a Chinese corporate-information database. For each Defendant, Plaintiff states (again, with no further explanation) that "there is nothing showing Defendant is at the provided address" or "there is nothing showing Defendant is at the provided address and the Chinese address we've found." The Court finds that, on this record, the "reasonable diligence" standard requires more. Where a plaintiff's investigation yields an identifiable physical location, reasonably diligent efforts require the plaintiff to pursue that lead through additional investigative stepssuch as test mailings to the address by an established courier, follow-up with the courier regarding any failed deliveries, or sending an investigator to the locationbefore deeming the address unknown. See Su v. HHUNSHA, No. 26 C 4878, Dkt. No. 25 (N.D. Ill. June 22, 2026); accord Nos. 26 C 6033 (N.D. Ill. June 15, 2026) (Alexakis, J.) & 26 C 6096 (Jenkins, J.) (minute entries) (finding reasonable diligence where counsel's sworn declaration detailed Baidu searches, a Qichacha search by the defendant's actual business name, multiple test mailings by an established courier, and personal follow-up with the courier). Database searches alone, without exhaustion of the addresses actually in Plaintiff's possession, are not a substitute for actual diligence. See Deckers Outdoor Corp. v. A AO, 2026 WL 1802901 (N.D. Ill. June 23, 2026); NBA Props., 549 F. Supp. 3d at 796. Plaintiff may file a renewed motion for entry of default supported by sworn declarations detailing the specific, diligent efforts takenand the outcome of those effortsas to each Defendant. Any renewed motion must also address the timing of Plaintiff's diligence showing: the Court considers evidence of reasonable diligence as of the time Plaintiff moved for electronic service, not as supplemented after the fact, and a deficient showing at that stage cannot be cured retroactively. See Deckers, 2026 WL 1802901, at *45. Accordingly, if Plaintiff cannot demonstrate that its original showing was sufficient when made, Plaintiff may need to effect service on Defendants anewwhether through the Convention or by a renewed motion for electronic service supported by an adequate diligence showingbefore default may enter. A status report is due on 8/31/2026. Mailed notice
