MINUTE entry before the Honorable Edmond E. Chang: (1.) The filing at R. 19 is not a motion, so it is terminated on CM/ECF (it is a brief in support). (2.) On review of the notice of correction, R. 17, Defendant 1 is not properly joined and is dismissed from this case. It is true that severance is an option, Fed. R. Civ. P. 21, but the pleadings are such a mess right now that there is no clean way to sever Defendant 1 and post a cohesive pleading on another docket. It is better to "drop" the party. Fed. R. Civ. P. The Plaintiff will have to file a separate case against Defendant 1. (3.) The Plaintiff shall file a Second Amended Complaint that corrects paragraph 61 and attaches the Corrected Amended Schedule A by 11/05/2026. (4.) The TRO motion [14] is taken under advisement. The motion 18 to seal is granted provisionally. The Court will again review the propriety of sealing when evaluating the underlying motion. MINUTE entry before the Honorable Edmond E. Chang: (1.) The Plaintiff's motion to seal [2] is granted in part and denied in part. Schedule A may remain, for now, under seal given the eventual goal of asset restraint. But insufficient grounds have been provided to overcome the strong presumption of public litigation in the true name of the Plaintiff, Fed. R. Civ. P. 10(a), as well as for the design patent at issue. The Plaintiff shall file a public version of the complaint by 08/12/2026. (2.) On review of Schedule A, the Court raises the propriety of joinder of the numerous Defendants. The Plaintiff shall review the opinion in Estee Lauder Cosmetics Ltd. v. Schedule A, 334 F.R.D. 182, 18789 (N.D. Ill. 2020), which involved trademarks, but the text and governing principles of by 35 U.S.C. 299(a) are similar to Civil Rule 20. The Plaintiff shall file a supplemental memorandum (under seal if appropriate) addressing the propriety of joinder by 08/17/2026. In lieu of the supplemental memorandum, by the same deadline, the Plaintiff may file an amended complaint with (a) one defendant or (b) a subset of the defendants along with a memo (under seal if appropriate) explaining why joinder of those defendants is proper.
