MINUTE entry before the Honorable Joan B. Gottschall: Plaintiff's Motion for Electronic Service of Process Pursuant to Fed. R. Civ. P. 4(f)(3) 65 is denied without prejudice for the following reasons. First, as explained in ¶ 4 of this court's Standing Order in "Schedule A" Cases, Dkt. No. 16, the court cannot resolve the motion without receiving admissible translations of the significant amount of Chinese-language material attached as exhibits to the instant motion. See Dkt. Nos. [65-1] to [65-4]. Second, plaintiff's citation to Judge Wood's minute entry and default judgment in Celine SA v. Sched. A Defs., No. 26-cv-1356 (N.D. Ill.) (Dkt. Nos. 36, 39, 40), is unilluminating because the docket sheet does not reflect the basis of Judge Wood's ruling. Third, plaintiff appears to have narrowed through investigation defendant's physical address to one of two addresses in China. See QCC Search Result, Dkt. No. [65-3] at 2; Baidu Search Result, Dkt. No. [65-3] at 6. If plaintiff refiles its motion, it must explain, if it can do so, why it should not be required, as part of its duty of reasonable diligence, to send a process server or investigator to check the addresses putatively associated with defendant. See Liao v. Sweetrear, 2026 WL 2333716, at *1-2 (N.D. Ill. Aug. 12, 2026) (Gottschall, J.). Mailed notice

MINUTE entry before the Honorable Joan B. Gottschall: In its memorandum of law 61 filed July 28, 2026, plaintiff clarifies that it is not seeking "to enact a freeze upon Defendant's financial accounts. to preserve statutory relief, but rather to preserve the Defendant's assets until an equitable accounting can be concluded through discovery so as to return to Plaintiff any profits directly tied to the sale of infringing products." Mem. 3. The apparent inconsistent arguments made by plaintiff before issuance of the preliminary injunction, Dkt. No. 53 at 3-4, have not been explained (plaintiff devotes nearly the entirety of its supplemental memorandum to arguing collateral matters, such as whether and in what circumstances post-judgment remedies will be available if it prevails). Regardless, based on plaintiff's clarifications in the instant memorandum 61, the record now adequately supports maintaining the asset freeze imposed by the preliminary injunction. Accordingly, the preliminary injunction 57 stands. The show-cause order 58 dated July 23, 2026, is discharged. Mailed notice.

#58

MINUTE entry before the Honorable Joan B. Gottschall: It has come to the court's attention that in moving for a preliminary injunction, plaintiff contended that freezing defendant's assets was appropriate because "[d]efendant may attempt to move any assets from any accounts in U.S.-based financial institutions to offshore accounts. The amount of damages to which Plaintiff is entitled as set forth in the Amended Complaint most likely exceeds any amount contained in any of the Defendant's frozen accounts." Mem. Supp. Mot. Prelim. Inj. 4-5, Dkt. No. 53. In making this argument, plaintiff departed from its position at the temporary restraining order stage, where it argued that defendant's assets should have been frozen to preserve its right to an equitable accounting. Mem. Supp. Mot. for TRO 23, Dkt. No. 32. Supreme Court caselaw makes pellucid that a pre-judgment asset freeze may not be imposed solely to protect a plaintiff's ability to collect any money judgment it obtains. Grupo Mexicano de Desarollo, S.A. v. Alliance Bond Fund, 527 U.S. 308, 319-25 (1999); CSC Holdings, Inc. v. Redisi, 309 F.3d 988, 996 (7th Cir. 2002). Plaintiff is therefore given until and including July 27, 2026, to tell the court any reason why the portion of the preliminary injunction freezing defendant's assets should not be dissolved. See O'Sullivan v. City of Chicago, 396 F.3d 843, 860 (7th Cir. 2005).Mailed notice
