AMENDED complaint by Hangzhou Yuanzu Technology Co., Ltd. against taozhanggui8, taozhanggui6, taozhanggui16888, taozhanggui8888 and terminating The Partnerships and Unincorporated Associations Identified on Schedule A
MINUTE entry before the Honorable Martha M. Pacold: Plaintiff's motion [16] is granted. The defendant(s) operating the storefront "taoyatou" are dismissed without prejudice. Fed. R. Civ. P. 21. By 7/15/2026, plaintiff is directed to file an amended complaint naming only the defendant(s) operating the storefronts "taozhanggui8," "taozhanggui6," "taozhanggui16888," and "taozhanggui8888." Plaintiff has discharged its obligation to respond to the court's show cause order [15]. Plaintiff's motion for expedited discovery [8] remains under advisement. The parties' 8/3/2026 deadline [15] to file a joint status report stands. Mailed notice.
MOTION by Plaintiff Hangzhou Yuanzu Technology Co., Ltd. to drop defendant(s) operating taoyatou pursuant to Rule 21
MINUTE entry before the Honorable Martha M. Pacold: Plaintiff brings claims against unknown "individuals and business entities" "conduct[ing] business through" five online storefronts. 1 17. The names of the storefronts are: "taozhanggui8," "taozhanggui6," "taozhanggui16888," "taozhanggui8888," and "taoyatou." 6. Plaintiff alleges it has been injured because the defendants, through the storefronts, have sold products that infringe on plaintiff's copyrights. 1 35. In a memorandum 7, plaintiff argues that it should be permitted to litigate its claims relating to all five storefronts in a single suit. The court concludes that plaintiff may join its claims relating to the four storefronts with the phrase "taozhanggui" in their names because one can sue the same defendant for unrelated transactions, and the facts support that the same defendant operates all four "taozhanggui" storefronts. See Wheeler v. Wexford Health Sources, Inc., 689 F.3d 680, 683 (7th Cir. 2012) ("[A] plaintiff may put in one complaint every claim of any kind against a single defendant[.] (citing Fed. R. Civ. P. 18(a))). The unique stem "taozhanggui" appearing in all four of the storefront names followed by similar numerical patterns plausibly suggests that these storefronts are operated by the same defendant. But the same cannot be said of the fifth storefront: "taoyatou." That name is markedly different than the other fourthe only commonality is the word "Tao" appearing in each, which the evidence shows is a Chinese surname. [7-1]. Many individuals might have this surname, and its appearance in "taoyatou" does not plausibly suggest that the defendant operating that storefront also operates the "taozhanggui" storefronts. Because there are separate defendants, the claims alleged against each must "aris[e] from the same transaction or series of related transactions." See Wheeler, 689 F.3d at 683 (citing Fed. R. Civ. P. 18, 20). By 7/27/2026, plaintiff is ordered to show cause why its claims against the defendant(s) operating "taoyatou" should not be dismissed or severed for improper joinder. Furthermore, the parties are directed to file an updated joint status report by 8/3/2026. Finally, plaintiff's motion for expedited discovery 8 remains under advisement. Mailed notice.
