Rowland: The last remaining Defendant, Zerzsemp, is a corporate entity and has made it clear that it does not plan to be represented by counsel in this action. Plaintiff's motion [82] is granted in part and denied in pat as follows: (1) ZerzSemp's counterclaims are dismissed with prejudice; (2) the Plaintiff's request for default pursuant to FRCP 55(a) is granted; and (3) Plaintiff's request for default judgment pursuant to FRCP 55(b) is granted in part, namely, the Court will grant Plaintiff its actual loss or defendant's profit and up to $20,000 in statutory damages under 17 U.S.C. � 504(c)(2). This case involves a throw pillow that sells for less than $30, the request of $150,000 against a defendant unable to afford counsel is unacceptable. On 7/24/26 the Court struck the hearing set for 8/20/26 [81]. The Plaintiff's request that this Court hear this motion at the hearing on 8/20/26 is denied. Further, the Court denied the Plaintiff's motion for preliminary injunction [81] as moot since any injunctive relief would be sought in the motion for default and contained in the default judgment. Plaintiff is to submit a default judgment proposed order to the proposed order box by 8/3/26. Civil case terminated. Mailed notice.
